California Atty. Gen. Rob Bonta filed a complaint Thursday alleging that a cohort of the companies that make “forever chemicals” partook in a massive corporate shell game to defraud the state and others. In an amendment to a 2022 lawsuit filed by Bonta against the makers of these chemicals, the state now alleges that several DuPont spin-off companies — New DuPont, Corteva, Chemours and Qnity Electronics — worked together to create a “fall guy” company designed to take the financial hit stemming from several multibillion-dollar pollution lawsuits while keeping the companies’ most valuable assets out of reach. “The DuPont Defendants cannot game the system by illegally moving assets out of reach, dodging liabilities for the harm they have caused, and calling it restructuring,” Bonta said in a statement. “I look forward to ensuring that these companies are held accountable for PFAS pollution and that their assets cannot be hidden behind corporate walls while their responsibilities are left behind.” The Second Amended Complaint, as the new amendment is called, was filed in U.S. District Court for the District of South Carolina on Thursday. A Federal Court judge has described the Commonwealth's $2 billion lawsuit against the chemical manufacturing company 3M over PFAS contamination at defence bases as "daunting". During the first case management hearing in Federal Court today the two parties agreed the Australian government's claim was "large and complex". It heard a 1,600 page statement of claim has been filed about alleged soil and water contamination at 28 defence bases across Australia, where firefighting foam containing PFAS chemicals was used. Justice Catherine Button told the court sitting in Melbourne she had "never seen a claim like this … and to characterise it as daunting would be an understatement, daunting for everybody". In March the Commonwealth announced it was seeking damages from US-based chemical manufacturer 3M and 3M Australia. It the largest legal claim ever brought by the federal government, attempting to recoup the costs associated with investigating, managing and remediating contamination from the legacy use of AFFF firefighting foam. Kathy Hochul to sign legislation banning PFAS in drinking water while also raising concerns about algal blooms. “What New York’s been experiencing, a lot of people, especially in the Hudson Valley, have been calling it thousand-year storms,” said Vanessa Fajans-Turner, executive director of Environmental Advocates New York. Fajans-Turner says more than ever, New York needs legislation to enforce stronger limits on PFAS in drinking water. PFAS, also known as “forever chemicals,” are a class of more than 15,000 toxic chemicals that appear in a vast range of everyday consumer products to industrial ones. They’ve been linked to kidney cancer and low birth weights. Fajans-Turner says heavy rains like the state recently experienced often aren’t absorbed by the soil.
