United Nations May Soon Affirm Statehood of Island States After Sea Level Rise

The United Nations General Assembly appears about to resolve one of the prominent legal issues caused by the sea level rise that is occurring mostly because of climate change: whether an island state that is no longer habitable because of sea level rise maintains its statehood and its UN membership. The answer is expected to be yes. On September 24 the General Assembly is scheduled to approve a Declaration on Sea Level Rise. The declaration has already undergone extensive deliberation and appears set for consensus approval. It provides: We recall that once a State is established, the disappearance of one of its constituent elements would not necessarily entail the loss of its statehood. We affirm the presumption in favour of continued statehood and in this respect we underscore the continuity of statehood in the face of sea level rise, as well as sovereignty, sovereign rights and responsibilities, and membership of the United Nations of such States, consistent with international law. We call for international support for States facing land territory changes due to sea level rise to continue to maintain institutional functions. When Olivia Besters began caring for the patch of soil beneath the chestnut tree outside her home in Freiburg, Germany, more than 35 years ago, biodiversity was not on her mind. “It was the optics,” she told me. The ground was compacted and littered with trash and dog “legacies”. Besters simply wanted the space directly outside her front door to look nicer. “Everything else came much later,” she said. “Thirty-five years ago, no one talked about climate change or insect decline.” Over time, one tree bed expanded into 36 across Besters’ neighbourhood of Herdern. So deep is her commitment to her tree beds that her children gifted her a bike trailer to cart around her watering system, her phone is filled with stunning pictures of the flowers growing in her tree beds, and she has been nominated for city-wide engagement awards. As towns and cities grow, biodiversity is being squeezed into ever smaller spaces while people experience a progressive loss of everyday contact with nature. South Australia’s sea lion population is increasingly being impacted by the H5 bird flu, with four of the mammals – including one pup – testing positive for the virus. The sea lions were among several found dead on the Pages Islands, between the South Australian mainland and Kangaroo Island, a key breeding location for the animals. There has also been a mass mortality event involving crested terns on the Pages, with about 900 of the birds found dead. SA Environment Minister Emily Bourke said out of 10 deceased sea lions available for testing, three adults and one pup returned positive results. The results bring the total number of South Australian sea lions with bird flu up to five, following a positive case at Kangaroo Island's Seal Bay last week.
