โ–  Istanbul Court Records, 1842 #history #divorce #1840s "Tatar Mehmed AฤŸaโ€™s Claim Against His Divorced Wife ร‚iลŸe Hatun Was Dismissed" (Read in Alt Text)
"Petitioner: Tatar Mehmed AฤŸa, son of Ahmed, made the following statement on Wednesday in the presence of Shaykh al-Islam, during the court session held in the honorable Sharia council:

During the time when my marriage with my former wife, ร‚iลŸe Hatun, daughter of Mehmed Salih, was still valid, we jointly held rights over a waqf-owned house located in Kefevรฎ District near Salmatomruk, Istanbul. Half of the property was under my authority with the trusteeโ€™s document, and the other half was under ร‚iลŸe Hatunโ€™s authority in the same manner. However, as this house fell into ruin, last year, ร‚iลŸe Hatun authorized me, under the condition of the right of reclamation, to manage her share. I personally covered the renovation and reconstruction expenses, amounting to a total of 4,394 kurush from my own property. Of this amount, I am now claiming 2,197 kurush and 10 para from ร‚iลŸe Hatun, corresponding to her share of the costs.

Moreover, on the 2nd of Rebialakhir, when I divorced ร‚iลŸe Hatun and separated from her, the following items of mine, left in her possession, are also being claimed: three rolls of Cyprus cloth worth 420 kurush in total, 50 arลŸins of American fabric, 48 arลŸins of blue-patterned textile, 50 okkas of wool, and various personal belongings valued at 2,500 kurush in total.

ร‚iลŸe Hatunโ€™s response was as follows: On the 2nd of Rebialakhir, regarding the aforementioned claims, Mehmed AฤŸa reached a complete settlement with me for 600 kurush for the house, thereby withdrawing all his claims. I accepted this settlement and paid him the agreed amount in full. Mehmed AฤŸa also formally waived all his rights and claims against me, as certified in a valid legal document of release.

After Mehmed AฤŸa fully and willingly acknowledged and confirmed this statement, the court ruled that he is barred from initiating any further legal action against ร‚iลŸe Hatun on this matter.

The decision of the Istanbul Court has been reported to the Shaykh al-Islamโ€™s office.
