Rent tech platforms use deceptive practices and AI to create dehumanising rental experiences

Rent tech platforms, which are online systems and apps used for searching, applying for, and managing rental properties, are increasingly incorporating artificial intelligence and manipulative design tactics that many renters find dehumanising. A new report from the Consumer Policy Research Centre, informed by PhD research, reveals widespread use of 'dark patterns' by these platforms to collect excessive personal data from renters. The report found that platforms often trick renters into providing unnecessary information through deceptive designs, such as personality questionnaires claiming to screen applicants based on 'agreeableness' or dubious reward programs. While Victoria has introduced new laws to limit invasive questions and ban third-party fees for services like ID checks, similar protections are lacking in other Australian states. Outside Victoria, platforms continue to harvest data through invasive practices, and even within Victoria, some platforms circumvent new laws by requesting additional personal information outside the application process. Renters have little choice but to use these platforms, as online listings often require their use, and they lack control over how their data is used. Privacy policies are vague and contradictory, often failing to inform renters about how their data is shared with third parties like debt collectors. The report calls for stronger privacy laws, better industry guidelines, and rigorous enforcement to protect renters from exploitative data practices. Current privacy protections for rental management are patchy, as small real estate businesses remain exempt from the Privacy Act, despite new anti-money-laundering rules. The federal government is proposing reforms to the Privacy Act, but renters' protections must be explicitly included in these changes to ensure comprehensive data privacy across Australia.
