I continue to think the Trump admin will lose on this issue. They are just so brazenly wrong on this that it's a bridge too far for the Supreme Court. Despite everything, my current prediction is at minimum a 7-2 loss for the Trump admin.

A reminder to law students and anyone else who needs it: failure to cite to, attempt to distinguish, and/or call for the overruling of on point negative precedent is sanctionable. In normal times these lawyers should lose their admission to SCOTUS, and risk losing their licenses for such conduct.

Incredible. They once again wrote a brief that simply pretends that Lynch v. Clarke, the first major case on birthright citizenship, just simply does not exist. It gets not a single mention or acknowledgment.

I’m seeing a level of student cynicism about the rule of law beyond anything I’ve experienced in many years of teaching. Not just in SCOTUS but in judges across the board. I understand why and I’m curious what this bodes for the future.

My only hesitation about “Kavanaugh Stop“ is that “Terry Stop” was coined after an actual case decided by a full Court, which is supposed to be what is required for a precedent. One Justice saying stuff in a shadow docket case? Nah.

With a hard September 30 deadline and harms on both sides, the Court had no choice but to make a decision more quickly and with less briefing than normal.

Kagan’s real problem here isn’t with the emergency posture, she just thinks the Court got it wrong on the merits.

She’s entitled to her opinion, but it’s not fair to criticize the Court for granting the stay in an expedited fashion. If they had denied it in an expedited fashion it also would have amounted to a preliminary ruling on a novel issue without full briefing.

1. He's talking about America's largest city. 2. "The money" is supposed to come from the U.S. Congress, not "me." 3. Trump's error on #2 is the fault of the cowardly Republicans in Congress and on the Supreme Court.

I wish liberals talked this way more. Because let's face it, most of the Supreme Court's precedents are not our friend. Without giving it much thought, we all could list several dozen that need to be overruled.

None of this is a surprise. This is what I wrote at Law Dork about the Supreme Court order and Kavanaugh's opinion in the racial profiling case back on Sept. 8: www.lawdork.com/p/scotus-….
On Monday morning, the U.S. Supreme Court’s right-wing majority allowed the Trump administration, as part of its sweeping immigration raids, to racially profile Spanish-speaking people who look Latino at certain low-wage job sites in the Los Angeles area while litigation challenging the raids is ongoing.

It is an order that makes a mockery of the Fourth Amendment’s protections against unreasonable searches or seizures, with significant worrying consequences for all people in America — whether you lack documentation to be in this country or are a citizen of it. Beyond the practical consequences, however, the existence of the Supreme Court order itself is alarming.

Monday’s action was allowed by way of a one-paragraph order that contained no reasoning — contrary to the July district court order at issue and the August appellate decision denying the government’s stay request, both of which were more than 50 pages long and detailed their reasoning at length.

NEWS: The Trump administration is, as was reported Friday, asking the Supreme Court to take up birthright citizenship. Notably, DOJ is asking SCOTUS to grant cert in the Washington multistate case and grant cert before judgment in the Barbara class-action case. More to come at Law Dork:
