I can't wait until there's a lawsuit about state censorship that inevitably reaches the Supreme Court. They'll add a clause to the First Amendment that explains why dissent to the president* & his party is like shouting "fire" in a crowded theater. *Some loophole in case the POTUS is a Democrat.

The popular phrase "yelling fire in a crowded theater" comes from a 1919 Supreme Court case, but the case did not involve anyone actually charged with that crime. The example was used as an analogy to illustrate that the First Amendment right to free speech is not absolute; which is still true today

Saw the new Baltimore filmed Christmas romcom The Baltimorons in a very crowded theater this evening surrounded by other Marylanders who also get a kick of seeing people talk about the Orioles and crabs on the big screen. Great film.

Not sure about the reason for this post. But the reason it is wrong to "shout fire in a crowded theater", even if not a violation of free speech, is because it may cause multiple deaths due to trampling. The Constitution limits free speech in its reference to suppressing Rebellion and Insurrection.

"should have chosen his words more carefully"? Journalism and comedy should not be censored - ever. When I was in college, we learned the only restrictions were you could not yell " fire" in a crowded theatre, unless there really was a fire, and you couldn't incite a riot or violence.

"Clear and present danger" is a legal standard established by SCOTUS that allows the government to restrict speech if it presents a clear and immediate threat of substantial harm. For example, falsely shouting "Fire!" in a crowded theater could cause a panic.

The law *used* to allow the government to jail you for publishing unfair and biased pamphlets about the evils of the draft. Such was “a clear and present danger” and could be banned. Why, letting people publish anti-draft pamphlets was like ”shouting fire in a crowded theater”! You want that back?
