Principled conservative jurists ARE concerned. The 6-3 majority thinks they can put their thumbs on electoral scales to stop Dems from getting a turn again, and if worst comes to worst, just change the rule again.

I’m hoping someone like @kenwhite.bsky.social can explain why conservative jurists are unconcerned about Dems availing themselves of all this unitary executive power when it’s their turn. My guess is that safeguarding rights takes constructive action, and firing ppl is a destructive power.

There's no supremacy clause problem with state bribery laws encompassing payment of bribes to federal officials, and California's statute does, it's not limited to state government bribes. They can and should open a criminal investigation. Not wait for some future DOJ, do a state one right now.

The motivations behind the Court’s protection of Trump are very different from the reasons that Congress and the White House neglected to pursue post-Trump reform. Viewed together, though, both failures reflect a broader unwillingness or inability across American institutions to adequately wrestle with the danger he poses. The story of Trump’s rise is in large part the story of governing bodies abdicating their responsibility to respond to his abuses in the hope that someone else will take care of it—including the Republican Party’s failure to halt his run for president in 2016 and 2024, the Senate’s failure to convict and bar him from office following both impeachments, and the Justice Department’s failure to move with sufficient speed to investigate and bring charges against him over January 6, such that Americans will almost certainly head to the polls in November without resolution in that criminal case.

What Pritzker's saying and doing isn't some particularly nuanced one neat trick kind of strategy. Most of it's fairly obvious. He's just the only one using the real constitutional crisis playbook against a consolidating authoritarian regime, meanwhile most other Dems aren't even on the right field.

He stands out not because he's any kind of radical but because he seems to understand the escalation ladder we're on here, and how many steps up it we already are. He's not just being hardline on principle, he's escalating because he's actually thought about the strategy of how this plays out.

I’m really grateful for Pritzker. But that he’s so good at this also makes clear just how badly most other Democrats are failing to meet the moment.

This "literature" is peer reviewed by....checks notes...nobody. In this instance, recency is not an asset since there is a mountain of research reaching the opposite conclusion. But when the literature does not say what you want, manufacture it through SSRN and launder it through a NYT oped.

He came here at age 13 more than 20 years ago. He got his first ever criminal arrest in August this year, a DUI arrest which got him on ICE’s radar. And they’re treating him like this.
