Judge Xinis is set to haul the government in front of her bench over the next two weeks and make them explain under oath what they're doing. I know the timeline seems awful given that Kilmar remains locked up. But this is not a case where she can just order him brought back tomorrow, given Bukele.

And that's it. Hearing over. There will be an expedited discovery period, with depositions set to be completed by 4/23.

Short hearing, and Xinis was all business. She dismissed. The DOJ objections is already dealt with and said it’s time to move to discovery, which will be very very rapid. DOJ proffered the oval office meeting yesterday; she wants evidence gathered under the evidence rules.

Informative thread on hearings before USDC Judge Xinis in the Abrego Garcia case. Having made insulting & moronic legal arguments, the Trump Administration will next engage in all manner of evasions in the discovery (including depositions) that the Court has ordered take place during next 2 weeks.

Judge Xinis is following exact procedure used in previous cases where cabinet officials held in contempt. See esp. Cobell v. Babbitt, 37 F.Supp.2d 6 (1999).

I can't understand the delay. What is the rule he has to break to make it contempt? Does he get a trial for that before Xinis can do anything?

Does she really not have enough NOW to determine contempt?

The administration clearly disagrees with Judge Xinis on this question. They appear to be operating under the (mistaken) assumption that the Supreme Court held in their favor. It would have been nice, however, if Roberts and co. had been less mealymouthed in their opinion.

Also notable: Judge Xinis kept quoting the Supreme Court and reminding DOJ that “the high court” has “already ruled here.” She said, quite forcefully, that the government has LOST this case on the merits—all that’s left is the scope of relief, and then contempt if the government defies her orders.

I do wonder whether a judge like Xinis beginning occasionally to put 'contempt of court', 'DOJ counsel' and/or 'those instructing the DOJ' in the same sentence, might act as a small wake-up call for those weaselling around actually carrying out court orders, thereby depriving citizens of liberty.

Judge Xinis slammed the DOJ for not giving information of value about returning Kilmer Abrego-Garcia. “I will not tolerate grandstanding or gamesmanship. Cancel all appointments & vacations.” Two weeks of extensive discovery, documents & depositions explaining the steps taken to bring Garcia home.

I love that Judge Xinis, by ordering the govt to tell her what they’ve done rather than telling them what to do, has reduced them to flailing. “The plaintiffs are demanding we do X, which is overreach!” Ah, but the court hasn’t asked you to do X. The court is just asking: *what have you done*?

Xinis: To talk in generalities is simply delaying the process we need to go through to determine whether you've done what you can in good faith to comply w/ order Ensign: Disagree that it's generalities. The plaintiffs have specifically asked court to compel gov to ask El Salvador for his release
